These Terms will apply to all persons and entities who access the Site (“Users”), including, without limitation, persons and entities who purchase items through the Site for their personal use (“Customers”) and end users who purchase items through of the Site for the purpose of reselling such items (“Consultants”).

Through the Site, Users residing in any part of the world (except Brazil and Canada) have the right to purchase products made available through the Site by Jewel, and check their description, as well as information related to the sale of Jewel products.

These Terms can be viewed at any time on the Website, via the link: www.jewel-hut.store/privacy-policy. THESE TERMS MAY BE UPDATED, AMENDED OR REPLACED BY JEWEL FROM TIME TO TIME WITHOUT PRIOR NOTICE TO YOU, WITH SUCH UPDATED, AMENDED OR REPLACED TERMS TO COME INTO EFFECTIVE UPON BEING POSTED ON THE SITE OR SUDOMAIN PAGE(S) THEREOF OR VIA HYPERLINK FROM ANY OF THESE PAGES. As a result, we recommend that you review these Terms from time to time to ensure that you are aware of the latest Terms, including before purchasing any products made available through the Site.” If you do not agree to the Terms, you must immediately refrain from accessing the Site and/or making purchases of any products made available through the Site.

1. Acceptance

1.1. By accessing the Site, Users declare their free, accepted and informed acceptance of the Terms contained herein. Users acknowledge that access to the Site depends on acceptance of this document and, therefore, if they do not agree with any of the following provisions, or any changes made to these Terms, Users must refrain from using the Site.

2. Rules and Features for Users (Clients and Consultants)

2.1. Users acknowledge that they will only provide complete and accurate information on the Website, exempting Jewel from any liability arising from any false or inaccurate information provided by them.

2.2. The Website is available for free access at www.jewel-hut.store, regardless of whether the User completes the data registration or not. The Website allows Users to make online purchases of Jewel products, consult the Jewel product catalogue, product descriptions and other information related to the purchase and resale to the end consumer by independent consultants.

2.3. If a certain product is not available for purchase, Users will be able to demonstrate their interest directly through the Website, regardless of any prepayment. When identifying the interest of a specific Customer or Consultant in an unavailable product, Jewel, at its discretion, will attempt to facilitate the purchase. However, in this case, Jewel does not guarantee that the purchase will be possible and is not responsible for any failure of the purchase.

2.4. All products purchased by Users will be delivered by third-party companies.

2.5. After placing the order, Users will not be able to change the payment method and/or delivery address, request advance payments or priority delivery.

2.6. Once the product has been purchased by the User, Jewel will only accept change for the size of the product purchased by the Customer or Consultant, but not for the model or the piece itself.

2.7. For both Clients and Consultants, payments can be made by credit card.

2.8. Jewel maintains a refund/return policy (the “Refund Policy”) that governs all purchases made through the Site. This policy is set forth at https://jewelhut.store/return-and-exchange/. You agree that your right to any refund and your right to return any products purchased through the Site are limited to the terms set forth in the Refund Policy.

2.9. It is possible for both Customers and Consultants to return Items, provided that:

2.9.1. The following return rules will apply to Customers:

1. a) The return must be requested within 30 (thirty) days after receiving the jewelry;
2. b) Jewelry must be sealed;
3. c) Jewelry must have a label;
4. d) Jewelry must be in perfect condition;

2.9.2. The following return rules will apply to Consultants:

1. a) The return must be requested within 15 (fifth) days after receiving the items;
2. b) All items received from the kit will be returned. It will not be possible to return just some of them;
3. c) Items must be sealed;
4. d) Items must be in perfect condition;
5. e) Return is not possible as a form of payment.
6. Additional Rules and Features for Consultants

3.1. Acceptance of these terms does not imply any exclusivity relationship between the Consultant and Jewel.

3.2. Consultants acknowledge that, to access the exclusive functionalities intended for Consultants, they must register data, including only complete and accurate information on the Website, exempting Jewel from any liability arising from any untrue or inaccurate information provided by them.

3.3. The Consultants declare to be aware that the inclusion of any false/adulterated data or information, as well as any improper or illicit use of the Website will subject them to all applicable legal sanctions.

3.4. Consultants will be able to select the campaign of their interest, from those available, the respective products and their description, as well as view the suggested price table for resale, provided by Jewel, and request price estimates.

3.4.1. The suggested price list is not binding, corresponding to a mere suggested resale price, and Consultants can freely define the values charged for the resale of Jewel products.

3.5. After selecting the products of interest to the Consultants and defining their specificities and quantities, the Consultants will be able to complete the purchase and after confirming the purchase, the Consultants will no longer be able to change or cancel it through the Website.

4. Proper Use of the Site

4.1. By accepting the Terms contained herein and using the Site, Users declare that:

(i) be at least 18 (eighteen) years of age and be civilly capable, in light of the law, of expressing your will in relation to these Terms;

(ii) they must not use the Website for any illicit purposes, contrary to morality and good customs or intentional misuse, respecting, when using the Website, any and all applicable legislation;

(iii) shall not use the Website in any way that may harm or infringe the rights of third parties;

(iv) will not include any inaccurate or false information on the Site.

4.2. By accepting the Terms contained herein, Users declare that they are aware that they must not insert into the Website, by any means, any content that incorporates viruses or other elements harmful to the Website and/or that harm Jewel’s or other Users’ systems.

4.3. Users declare to be aware that they are solely responsible for the specific use of the Site, exempting Jewel from any responsibility for any illegal or inappropriate use of the Site or contrary to these Terms.

4.4. Users acknowledge that, under any circumstances, they will be solely responsible for their access passwords, acknowledging that they will not share them with third parties under any circumstances and exempting Jewel from any liability arising from unauthorized third party access to the Platform, due to inadequate treatment password by Users.

4.4.1. By accepting the Terms contained herein, Users declare to be aware that their access password may need to be changed at least every 90 (ninety) days.

4.5. Any registration of civilly incapacitated persons will be considered not permitted by these Terms. If the incapable person continues with such registration, their legal representative may contact Jewel to request the deletion of such data, using the email address provided at the end of this Policy.

5. Intellectual Property

5.1. All texts, images, photos, icons, technologies, links and other visual, audiovisual or sound content, including graphic designs and source codes on the Site are the exclusive property of Jewel (or third parties who have authorized their use by Jewel) and are protected by national and international laws and treaties, and copying, reproduction, downloading or any other type of use of them, for commercial purposes or not, is expressly prohibited. Any violator will be subject to applicable civil and criminal penalties under U.S. law.

5.2. All brands, trade names or logos of any kind portrayed on the Site are the property of Jewel (or third parties who have authorized the use of them by Jewel), and the use of the Site cannot be understood as authorization for Users to use these trademarks, trade names and logos.

5.3. Users acknowledge that they will not use texts, images of artists, models or people hired by Jewel, and other content made available through the Website, in any aspect, such as electronic pages, leaflets and other forms of advertising, even if to sell Jewel products, and any use of such content, which is not expressly authorized by Jewel, will be understood as a violation of the Terms contained herein and the applicable rules.

6. Disclaimer

6.1. Jewel is not responsible:

(i) for any unavailability, errors or failures of the Site, or for failures of the Site or any access difficulties;

(ii) due to errors or inconsistencies in data transmission or in the quality or availability of the Internet signal, which cause failures in the normal functioning of the Website;

(iii) due to the existence of viruses or other harmful elements on the Website, which may cause changes in the computer systems (software and hardware) or in the digital documents stored in the computer system, excluding any responsibility for any damages resulting therefrom;

(iv) for any inaccurate or out-of-date information included on the Site;

(v) for any damages resulting from knowledge, by unauthorized third parties, of any information provided by the Website, resulting from a failure exclusively attributable to the Client, Consultant or third parties that are beyond Jewel’s reasonable control; nor

(vi) to third party electronic pages, including advertisers, whose links are inserted on the Jewel website, as well as to third party pages that present links or references to Jewel.

6.2. Furthermore, Users will exempt Jewel, its subsidiaries, affiliates, officers, workers, agents, contractors or other representatives, shareholders and employees from any claims and demands and will indemnify Jewel for losses, damages, including related to legal fees, resulting from non-compliance with the Terms and Policies of use or violation of rights.

6.3. Jewel will not be responsible for any failure to the extent attributable to third parties who will be solely and exclusively responsible for delivering the product and processing authorization to charge the Users’ credit card.

6.4. LIMITATION OF LIABILITY. IN NO EVENT SHALL JEWEL BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF PROGRAMS, LOST PROFITS, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR SERVICE INTERRUPTIONS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE AND/OR ANY RELATED SERVICES, EVEN IF JEWEL OR ITS AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT ANY CLAIM BY YOU OR ON YOUR BEHALF MUST BE MADE IN WRITING TO JEWEL AND RECEIVED BY JEWEL WITHIN ONE (1) YEAR AFTER THE EVENTS GIVING RISE TO SUCH CLAIM. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MAXIMUM AMOUNT FOR WHICH JEWEL ASSUMES RESPONSIBILITY, REGARDLESS OF THE REASON GIVING RISE TO THE ORDER, CORRESPONDS TO THE AMOUNT EVENTUALLY PAID BY THE USER TO JEWEL WITH RESPECT TO THE PRODUCT THAT IS THE SUBJECT OF SUCH CLAIM, PROVIDED THAT THE ALLEGATION DA LOSS IS INDUSTRIALLY PROVED.

6.5. Users are aware that Jewel recommends the use of properly secure and up-to-date tools and technologies (hardware and/or software). Any use, by Users, of outdated tools and technologies, not considered safe, will be at the Users’ own risk, with Jewel exempting itself from any responsibility for any type of damage incurred by Users.

7. Privacy Policy

7.1. Jewel gathers all information actively entered by Users on the Website, such as, for example, information entered into forms on the Website (name, address, telephone, date of birth, email and payment details), as well as some information automatically generated when Users use the Site, such as IP characteristics with date and time of access. No method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, Jewel does not guarantee the absolute security of your personal information. Jewel may transmit your personal information outside your jurisdiction of residence.

7.2. Jewel may collect information about the device and browser you use, your network connection and your IP address. Jewel may also receive personal information about you when you purchase products or make other requests to Jewel. Jewel may use this information to service your account, improve the services and products made available by Jewel, and answer any questions you may have.

Additionally, in connection with the purchase of products and services, you may be required to provide your personal information directly to third parties. In certain limited circumstances, Jewel may also be required by law to share information with third parties. You agree that Jewel will have no liability if any third party fails to protect your personal information in accordance with these Terms or otherwise in accordance with applicable laws.

Personal information may be shared with third parties to prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of these Terms or any other agreement relating to these Terms or any services or products provided by Jewel, or as required by law.

7.5. Personal information may also be shared with a company that acquires Jewel’s business, whether through a merger, acquisition, bankruptcy, dissolution, reorganization or other similar transaction or proceeding.

7.6. After your relationship with Jewel ends, Jewel will continue to store archived copies of your personal information for legitimate business purposes and to comply with the law.

7.7. You retain all rights to your personal information and can access it at any time. Additionally, Jewel takes reasonable steps to permit you to correct, amend or delete personal information that proves to be inaccurate or incomplete. 7.10. Users express their free, express and informed consent to the use by Jewel of the data collected about them or by Jewel’s partners for the purposes described in the Terms of this document.

7.11. Furthermore, Users acknowledge that data collected by the Website may be shared with third parties in the following situations:

(i) within the scope of commercial activities and services provided by Jewel, also with its commercial partners;

(ii) to protect Jewel’s interests, in any type of conflict, including legal actions; or

(iii) in connection with a court order or request from administrative authorities.

7.12. Users may request the deletion of collected data and consequent termination of access to the Site by contacting Jewel by email: sales@jewelhut.store. Jewel will use commercially reasonable efforts to fulfill all orders in a timely manner, and after the order is successfully processed, your registration with Jewel will be automatically canceled.

7.13. Even in the case of a request for data deletion, as indicated above, Jewel will observe the minimum period for storing the information if, and to the extent, required by applicable legislation.

8. Term and Termination of Access

8.1. Access to the Website is granted to Users for an indefinite period of time, and Jewel is responsible for terminating availability at any time, including as a result of improper use of the platform, regardless of prior notice and no type of compensation will be owed to the Client or Consultant in accordance with the termination. Jewel reserves the right to immediately suspend or terminate your access to the Site, without prior notice, upon any breach of these Terms by you. If your registration is canceled or terminated at any time by you or Jewel, you will not be entitled to any refund or reimbursement of any amounts paid to Jewel.

8.2. Users acknowledge that Jewel may, at its free and exclusive discretion and without prior notice, cancel the Client’s or Consultant’s access to exclusive access to the Website for registered users if such access is inactive for more than 90 (ninety) days.

9. Miscellaneous

9.1. Any clause or condition of this instrument that, for any reason, is considered null or ineffective by any judge or court, will not affect the validity of the other provisions of these Terms, which will remain perfectly valid and binding, generating effects to their maximum extent.

9.2. Jewel’s failure to enforce any rights or provisions of the Terms contained herein will not be considered a waiver, and you will have every right to regularly enforce your right within the appropriate legal terms.

9.3. Your right to access the Site is for your exclusive and personal use. You may not authorize third parties to use your registration, and you may not assign or otherwise transfer your right to access the Site to any other person or entity.

9.4. Jewel may provide, or third parties may provide, links to other sites and/or resources. You acknowledge and agree that Jewel is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, services or other materials on or available from such sites or resources. You further acknowledge and agree that Jewel shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, advertising, products, services or other materials available on or through of any website or resource.

9.5. DISCLAIMER OF WARRANTIES. JEWEL PROVIDES THE SITE AND RELATED SERVICES AND PRODUCTS “AS IS, WHERE IS” AND MAKES NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, IN CONNECTION WITH THE SITE AND/OR ANY SERVICES AND/OR PRODUCTS RELATED TO OR IN CONNECTION WITH ANY COMMUNICATIONS WITH JEWEL OR ITS REPRESENTATIVES, OR OTHERWISE WITH RESPECT TO THE SITE AND/OR SUCH SERVICES AND/OR PRODUCTS. JEWEL SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. JEWEL DOES NOT WARRANT THAT YOUR USE OF THE SITE WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE OR ERROR-FREE, OR MEET YOUR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SITE WILL BE CORRECTED. FURTHERMORE, JEWEL DISCLAIMS ANY LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS OR OMISSIONS OF OTHER END USERS OF THE SITE AND/OR RELATED SERVICES AND/OR PRODUCTS (INCLUDING, BUT NOT LIMITED TO, UNAUTHORIZED USERS, OR “HACKERS”).

10. Applicable Law and Jurisdiction

10.1. These Terms are governed exclusively by the laws of Florida/USA, without regard to conflicts of laws principles.

10.2. The parties elect the exclusive jurisdiction of the federal and state courts in the State of Florida/USA, Miami-Dade County, to resolve any doubts, issues or controversies arising from the Terms contained herein, with express waiver of any other, regardless of whether the issues of privilege and submit to the exclusive jurisdiction of such courts in connection with any dispute relating to the Site, any related products or services, or otherwise under these Terms.
